Effective October 20, 2026. These terms are an agreement between you and Cake Concierge, a sole proprietorship in San Diego, California ("Cake Concierge", "we", "us"). By creating an account, placing an order, or checking the box at sign-up, you agree to them. If you sign up for a company, you confirm that you may bind it, and "you" means the company.
1. What we do
We arrange cakes from partner bakeries and deliver them, boxed and with the bakery's ingredient label, to offices in San Diego County only. We do not bake. We confirm your office address by phone before the first cake.
2. Your account
Keep your login private and your people list current. You are responsible for what anyone you give access to does under your account.
3. Your people and their information
To run your plan you give us names, birthdays, work anniversaries and any dietary notes for the people you add. You confirm that you are allowed to share this with us. Anyone can opt out at any time through the team link or by asking you, and you can remove anyone.
We use this information only to schedule, make, label, deliver and bill cakes for you. We do not sell it or use it for marketing, and we delete it within 30 days after your account ends. Partner bakeries see only what they need to make and label a cake. Our Privacy Policy explains the rest.
4. Cakes and prices
Team cakes start at $55 delivered. Signature cakes are $75 and $85, and a half sheet is $95. We may change prices. We will email the billing contact at least 30 days before a change, and cakes already ordered keep the old price. We add sales tax only where the law requires it.
First cake free. If your company has at least five active people on file, your first delivered cake is free up to $55. A more expensive first cake bills only the difference. One free cake per company, including related companies at the same address. It has no cash value and does not apply to single custom cakes.
5. Billing
You keep a card on file with Stripe, our payment processor. Once a month we send one invoice that lists every cake delivered that month, with the person's name and the delivery date, and we charge the card. You pay only for cakes that went out. There is no contract, no monthly fee, no setup fee and no minimum. If a charge fails, we will let you know and may pause deliveries until it is settled.
6. Skipping, pausing and cancelling
Your account shows every cake planned for the next 60 days. You can skip a cake from your account or from a skip link until the bakery accepts the order, usually noon on the business day before delivery. After that the cake is being made and will be billed when delivered.
You can pause or cancel at any time from your account or by email, with no fee and no notice period. Cakes the bakery has already accepted are delivered and billed. Nothing further is ordered. If you set a monthly cap, we will not send more cakes than it allows.
7. Delivery
We deliver to your office front desk during the front-desk hours you give us, before lunch on the delivery day. Birthdays on a weekend or office holiday move to a nearby business day. Someone must receive the cake. We do not leave cakes unattended. At hand-over we photograph the cake, record the name of the person who received it, and email both to you. After hand-over, keeping the cake cool and deciding who eats it are up to you.
If a delivery fails on our side (a late bakery, our vehicle, the wrong cake), you are not billed. We will replace the cake as soon as we can or credit you.
If a delivery fails on your side (the office is closed, no one is at the desk during the hours you gave us, or the address is wrong), we will try to reach you and attempt delivery again the same day if we can. A cake we cannot hand over for these reasons may still be billed, because the bakery has already made it. If this keeps happening, we may pause the account until the details are fixed.
8. If something is wrong with a cake
If a cake arrives damaged, with the wrong name, or not what you ordered, tell us within 24 hours with a photo. We will replace it or credit the full price. Previews on the site are drawings, and the real cake will differ in small ways.
9. Allergens and dietary needs
Our cakes come from kitchens that may also handle wheat, milk, eggs, soy, tree nuts, peanuts and sesame. We do not promise that any cake is free of any allergen, including gluten-free or vegan cakes. We pass dietary notes to the bakery, but they are information, not a guarantee. The bakery's ingredient label travels with every cake. Check it before anyone eats. For anyone with a severe allergy, choose "No cake for me" or contact us first. You decide who at your office eats the cake.
10. Single custom cakes
If you order one cake through our designer rather than a plan, you pay the full price, including delivery, at checkout. You can cancel or move the date for a full refund until three business days before delivery, when we order the cake from the bakery. After that we cannot refund it, though we will try to move the date if the bakery can. Everything else on this page applies to single cakes too.
11. Your logo, messages and photos
You give us permission to use the names, messages, logos and photos you provide only to make, label and deliver your cakes and to show you previews. You confirm you have the right to use them and that they are not offensive or unlawful. We may decline a design. We will not use your logo or delivery photos in our marketing without your written permission.
12. Emails and texts
Order, delivery and billing emails are part of the service. We do not send texts yet. If we add texting, it will be opt-in with its own checkbox, you can reply STOP at any time to end it, and message and data rates may apply. Agreeing to texts will never be a condition of buying.
13. Our responsibility to you
We will deliver with reasonable care. Our total liability to you for any claim arising from these terms or the service is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect, incidental or consequential damages, or for lost profits. These limits do not apply to harm caused by our gross negligence or willful misconduct, to personal injury caused by our negligence, or to anything California law does not let us limit.
14. Your responsibility to us
You agree to cover us against claims, losses and reasonable legal costs that arise from your misuse of the service, from content you provide that you had no right to use, or from sharing people's information with us without the right to do so.
15. Ending the agreement
You can cancel at any time (section 6). We may pause or end service, with notice by email, if a charge stays unpaid, if we cannot confirm your address, or if you misuse the service. Sections 3, 9, 11, 13, 14 and 16 continue after the agreement ends.
16. Law and disputes
California law governs these terms. If something goes wrong, please contact us first so we can put it right. Any lawsuit must be brought in the state or federal courts in San Diego County, California, and either of us may use small claims court there instead.
17. Changes to these terms
We may update these terms. We will email you at least 30 days before a change takes effect. Cakes already ordered follow the terms in place when they were ordered. Using the service after a change takes effect means you accept the new terms.
18. Other things
If a court finds any part of these terms unenforceable, the rest stays in force. These terms, your orders and the Privacy Policy are the whole agreement between us. You may not transfer this agreement without our written consent.
